Terms of Service
Last updated July 20, 2026. These Terms are a binding agreement between you and TSI (“we”, “us”) for use of Appify.
1. Agreement
By creating an account, accessing the website, or using Appify (the “Service”), you agree to these Terms, our Privacy Policy, Acceptable Use Policy, and Billing & Refunds policy. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.
2. The Service
Appify is an AI-assisted platform for designing, previewing, publishing, exporting, and building mobile apps (including Expo / EAS workflows). Features may change, be limited by plan, or depend on third-party providers (for example OpenRouter, Expo, Apple, Google, Stripe, Supabase, hosting, and storage).
3. Accounts
- You must provide accurate account information and keep credentials secure.
- You are responsible for activity under your account and workspace.
- We may suspend or terminate accounts that violate these Terms or create security / abuse risk.
4. Your content and apps
You retain ownership of content you submit and apps you create (“Customer Content”), including prompts, designs, assets, app definitions, and exported source. You grant us a limited license to host, process, display, and transmit Customer Content solely to operate and improve the Service (including generating previews, builds, and AI outputs).
You are responsible for ensuring you have rights to all Customer Content (including images, trademarks, and data about end users of apps you publish).
5. AI outputs
AI features may generate designs, code, copy, images, schemas, and suggestions. Outputs can be inaccurate, incomplete, or infringing. You must review outputs before publishing or distributing them. You are solely responsible for apps you ship to end users and for compliance with app store rules, privacy laws, and industry regulations.
6. Third-party services and credentials
If you connect Expo, Apple, Google, Stripe, Supabase, AI keys, or other credentials, you authorize us to use them only to perform requested actions (builds, signing, data provisioning, proxies, etc.). You are responsible for those third-party terms and for rotating compromised secrets. Do not store secrets in client-visible app env fields.
7. Acceptable use
You must follow our Acceptable Use Policy. We may remove content, stop builds, or disable accounts that violate it.
8. Plans, fees, and taxes
Paid plans, trials, and usage limits are described in-product and in our Billing & Refunds policy. Fees are generally non-refundable except where required by law or expressly stated.
9. Intellectual property
The Service (software, branding, UI, and documentation) is owned by TSI and its licensors. Except for your Customer Content and exported project materials we generate for you, these Terms do not transfer our IP to you.
10. Confidentiality
Each party may receive confidential information from the other. Recipients must protect it with reasonable care and use it only for purposes of the Service, except for information that is public, independently developed, or required to be disclosed by law.
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation, successful app-store approval, or that AI outputs will meet your requirements.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TSI AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY ARISING OUT OF THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM (OR USD $100 IF YOU HAVE NOT PAID).
13. Indemnity
You will defend and indemnify TSI against claims arising from your Customer Content, your apps, your end users, your credentials, or your violation of these Terms or law.
14. Termination
You may stop using the Service at any time. We may suspend or terminate access for breach, abuse, non-payment, or legal risk. Upon termination, your right to use the Service ends; provisions that should survive (IP, liability, indemnity) will survive. You should export projects you need before closing your account.
15. Changes
We may update these Terms. Material changes will be posted with an updated date (and may be notified in-product). Continued use after the effective date constitutes acceptance.
16. Governing law
These Terms are governed by the laws applicable to TSI, without regard to conflict-of-law rules. Courts in that jurisdiction will have exclusive venue, except where mandatory consumer protections apply.
